Legal Question in Immigration Law in California

Taxpaying NON-statused woman ''seeking a country''

45 year old Phillipino woman has lived & intermittently worked in Los Angeles area for last 10 years. Social Security Admin. issued her a SS# and she has filed taxes with the IRS during working years. She has been seperated from her abusive husband for over 5 years. Yet she is not legally seperated from him. None of her immediate family is legally here. What should she be seeking? Green card? Permanent Resident status? Amunity? Is there a ''fast track'' method to expedite this process [considering her circumstances]?

Re: Taxpaying NON-statused woman ''seeking a country''

Thank you for your posting, and I am sorry to hear about this woman's circumstances.

The first part of the answer is simple ... if she is not in status, there is nothing she can do. She must leave the country and re-enter on a valid visa to start with any procedure.

From there, she may be eligible for a family green card, if she has family that is a citizen here, or political asylum, or a work permit visa, or a professional visa, none of which I can tell if she is eligible for under the facts you have given me.

Thanks again, and I hope this answer helps in some way. If you have additional questions, want to give me more facts, or want to proceed with representation, please feel free to call me at 1-877-568-2977, or just email me directly. I'm happy to help in any way that I can. Best of luck.

She needs a consultation with an immigration attorney. We charge $50 for a consultation and will waive it, if we are retained. Also, many attorneys will offer free consultations. So, start making the calls. Good luck.
