Legal Question in Insurance Law in California

On Dec 7th, 2013 our parked car was hit by a drunk driver, who hit and ran and later was caught by the cops. Our car was not drivable and had to be towed. Our insurance policy does not cover rentals. The police report for this incident has still yet to be completed, leaving us car-less and at the mercy of others for transportation. We do not have the money to pay the deductible, and the other parties insurance refuses to help until that report is received and refuses to call the police to get any necessary information, even though we have already provided them with everything they need. Our car is now fixed, but has been accruing storage fees bc the other insurance refuses to pay for the damages. We were also never given a rental. Is there anything we can get for the past four weeks of having our only mode of transportation taken away by a drunk driver, and for the storage fees that are accruing?

I am a little confused as your question has some contradictions. I do not understand if you did have auto insurance why it would not cover your rental. If you know who hit your car then you could sue in small claims court. If you would like to discuss in more detail feel free to call my office Monday.

Sue the person that hit your car in the small claims court for the damage and loss of use.
