Legal Question in Insurance Law in California

Driving with out a license, and reporting to DMV

I got in a fender bender about 3 weeks ago and the chick who hit me didn't have a license, registration, or insurance We agreed to not call the cops b/c I was sympathetic to her and it was only some minor bumper damnage, and she agreed to pay for it. Since there was no police report filed, would anything happen to her if I filed a claim against her considering she had no license? I don't want her license to be revoked, but I would like her to pay me my money which she has not done.

Give her an estimate so she knows exactly what it will cost, and a deadline to pay you the money. If she doesn't pay, or agree to pay the shop ahead of time, sue her in small claims court for $5k or less.

If you turn this in to your own insurer, you can also get your car fixed, less your deductible.
