Legal Question in Insurance Law in California

I have enrolled my son in a home preschool. It is very good, but they do not have liability insurance. They have asked me to sign a form acknowledging they do not have liability insurance.

If I sign this acknowledge, are they still liable?

Basically, I just want to be sure that signing this acknowledgement is not the same thing as waiving them from their liabilities.

I haven't read the form, but I doubt it would affect anyone's liability were something to happen. You just won't be able to sue them.

I disagree with Mr. Stone. If the document says only that the school lacks liability insurance, then signing it would not waive their liability and would not prevent you from suing them.

But since the school lacks insurance, it will have a hard time paying any judgment you might win against it. If the school had insurance you would have a much better chance at recovering a reasonable amount of damages if your child is injured. The school is asking you to acknowledge that you have been told about these facts.
