Legal Question in Insurance Law in California

Farmers Ins after accident settlement

I have hired a lawyer to take care a car accident that I had back in 2004. It was the other party's fault and their insurance was Allstate. My insurance is Farmers. The final settlement was paid to the lawyer and they provided me with certain percent of the settlement. Now for some reason, my insurance company is after some medical expense that was paid to the lawer and since they cannot get in touch with the lawyer and they were after me for the payment which I never receive. Now they theaten me if I don't pay they will put it into collection.

How do I need to handle this situation ?

Thanks.

Re: Farmers Ins after accident settlement

Each situation is different, but the lawyer's share of the payment typically covers only his fee and the costs he paid in handling the case. It usually would not include money to pay the client's medical bills, which would remain her responsibility. Did your lawyer tell you he would pay this bill? Does your contract with him say he will? Did the settlement agreement specifically say this is how it would be paid? If not, is there some other reason you think the bill should be paid from the funds he received?
