Legal Question in Insurance Law in California

Grace period for insurance claim

I recently got into a fender bender accident with another car. I want to know if there is a grace period

for claiming insurance. The guy said it was my fault but I'm not so sure. The last time we had contact has been over a month. I already told him that I was going to pay for the damage out of my pocket to prevent insurance claims. I was wondering what would happen if I didn't reply if he contacted me again.

Would he be able to claim from my insurance, he has my insurance policy number my name and my driver's license. Is there a time limit that he has to follow to claim insurance or contact me? Thanks

Re: Grace period for insurance claim

He has one year to make a claim for injuries and three years to make a claim for damages. If he has your information he will probably contact your insurance company if you don't pay for the damages. Was there a police report taken? What kind of damage was done to his car? What if any kind of damage was done to your car? These are the kind of questions the insurance company will ask before they pay a claim. If you truly do not think it was your fault make a claim with your insurance company and they will decide whether to pay or not. This is the reason you pay for insurance.
