Legal Question in Insurance Law in California

Motorcycle Accident Claim

I received a Policy limit settlement for a motorcycle accident I was involved in from the at fault party insurance company. It has been 5 month since and I have not received payment. My own insurance company refuses to pay the claim. Shouldn't my own insurance company pay the claim--name removed--if the other one has defaulted?

Re: Motorcycle Accident Claim

The insurance company may have paid some or all of your medical bills directly rather than sending the money to you. You should check with any doctors or hospitals that treated you to see whether they have been paid by the insurer.

Your insurance company is obligated to pay only the types of claims for which you bought insurance. If you only have liability coverage but not bodily injury, then the company does not have to pay your claim. The fact that the other insurer has failed to pay does not give your insurer any duties beyond those listed in your policies.
