Pedestrian vs Auto, Underinsured coverage

A pedestrian is killed while crossing the street by a driver with $30,000 worth of coverage. The pedestrian had underinsured motorist coverage on his own auto insurance policy. A claim was made against the pedestrian's policy for his BI limit less $30,000. It was denied by his insurance company because he was not a passanger of an auto at the time of the accident. Is this correct?

Generally, Under insured motorist policies are broad enough to cover pedestrians in certain situations. This could be one of those a review of the policy language is called for. The rejection is to be expected and is not conclusive. I would be interested in speaking to you about this further.
