Legal Question in Insurance Law in California

Personal Property Damage

My car was parked and hit on Oct 5, 2008. The lady that hit my car hit 12 other cars. I have been trying to get my money from the ladies insurance company. The insurance company has an estimate of my damages. They are saying they can't release any funds until everyone has gotten their claim in, I find this hard believe suppose the tqwo other people they are waiting decided to never put in a claim. What happens to the people that have done what they were supposed to do?

Re: Personal Property Damage

If you have a collision coverage I suggest you use it. Otherwise with 13 cars damaged you can rest assured you'll not be getting a fair shake. The reason is that most people buy low coverage insurance, such as 15/30/5, meaning only $5K to cover the property damage. So, with 13 cars you do the math.

If you don't have a collision coverage, sue the lady in a small claims court and get your judgment pronto. The only thing with the small claims however, it is capped at $7500.00
