Post accident chronology

On 12-21-01 My vehicle was hit in the rear by another motorist. It is now 1-19-02 and my truck has still not been repaired. The other parties insurance has not contacted me yet. Is there a time frame when they are supposed to contact me. ?

You need to file a claim with both your own insurance carrier and the carrier of the driver that hit you. If you have not already done so, obtain an estimate for the repair work and submit it along with a copy of the police report or a statement by you of what happened. There is a one year statute of limitations, which means that if you are not compensated fully or are not satisfied with the compensation you receive, you must bring a lawsuit against the other driver.

They do not have to contact you. You need to contact them or contact your own insurance to have them pay for your repairs and try and collect the deductible back from the other insurance company.

They are not required to contact you ever. You either go to small claims court or you lose.

You have a 3 year statute to file regarding property damage and a 1 year statute for personal injury in California. There is no law that requires an insurance company to respond to you. That is up to them. If it was your own insurance company, then you can force the issue.
