Does prop 213 affect the passengers in a un-insured car when the un-insured car is not at fault?

Not usually, unless the passengers were themselves the owners of the car or the employer of the driver of the car. The law requires those who own or drive a car to make certain the car that is being driven has insurance. Not innocent passengers.
