Legal Question in Insurance Law in California

rental car coverage

Hello,

I was rear-ended by someone and his insurance paid for the damages as well as the rental car. Not even a year later, the paint was cracking and the bumper was falling off. So I went back to the other person's insurance and they approved the ''redo'' of the bumper however they are giving me half of the coverage of the rental car compared to what they gave me in the beginnning. Their reason is that it is comprable to my type of car, I asked about the rental coverage they gave me the first time it was being repaired and they said that was a mistake on their part. Is this okay for them to change the rental coverage and do I have no choice? I was told by the first insurance adjuster that the coverage in the beginning was comprable to my type of car but now I am being told that it wasn't. I feel that I should get the same coverage since it is not my fault that the repair was not done right in the first place. Could you help clarify this for me? Thank you very much for your time and help.

Re: rental car coverage

You should write the adjuster a letter setting forth your position, requiring them to respond - in writing. If you are not satisfied, sue the defendant who hit you for the difference in rental car charges - in small claims court.
