Legal Question in Insurance Law in California

Vehicle Theft Liability

I locked the keys in the company van one evening and the van was broken into and stolen and wrecked. Am I considered the responsible person or neglectful in this situation?

Re: Vehicle Theft Liability

You appear to be neglectful, but if you were acting within the scope of your employment, you are not personally responsible as the company's insurance company should pay for the theft. You did not cause the theft - the van was locked and broken into. That is an auto theft because you did not enable the thief to get into the vehicle.
