Legal Question in Intellectual Property in California

Hello,I,m from Spain,when I,m in California in 2002 a friend of mine make some photos to me,now after 8 years other friend call me and tell me that guy is using my photos in topless in his profesional web site to make money,so I want to knows if I can demand that guy and if he has to paid me for use that all that time with no my permission.Thanks a lot.Cheers
