Intellectual Property Quesiton

Is it a violation of copyright law to make a techno remix of an 80's pop song and then sell it? I have seen these before and am wondering if it is legal.

Most likely the proposed remix would be considered a derivative work, and therefore without the permission of the copyright owner any commercial use of the remix would violate copyright law.
