Legal Question in Intellectual Property in California

How do I register my business name?

Hi. I was wondering how can I register a name.. so that no one else in California can use or have rights to a name. For ex.) ''Doggy entertainment?'' I want to open a website, under the name and dont want anyone else to have the rights. How do i do this, where do i go to do this?

As a first step, search the internet and elsewhere to make sure the name isn't taken already.

Register your business with the California Secretary of State. Check their website to make sure nobody else is using that name already.

Register the name with the US Patent and Trademark Office. This type of registration is more complex and takes more time, but it provides you with the best legal protection.

Re: How do I register my business name?

You should conduct a trademark search and also check with the California Secretary of State to see if that name has already been registered as a business entity. If both searches come up clean, then you should apply for a trademark with the United States Patent and Trademark Office. We can help you do all of that as well as provide you with proper counsel as to how to use this intellectual property to further your business. Please do not hesitate to contact me if you have any further questions or would like to get started.

Re: How do I register my business name?

It is not quite that simple - please take a look at the trademark law overview on my site. You should retain a trademark attorney to assist you with these matters. In the meantime, of course, it doesn't hurt to purchase the domain name(s) in question. Good luck with your venture.
