Legal Question in Intellectual Property in California

Trademark Not used for any established business

I am starting a business with a large growth potential, i have everything legally squared away except one thing. It is trademarked, at least on the .gov search. The business is not registered on any level with any goverments. It seems that it was purchased a few years back and a file for opposition (which i do not know what that means) was filed last year. Is their still a chance I may be able to obtain this TM or am I going to have to change all my identity for this?
