Legal Question in Intellectual Property in California

Trademark

I know a model who goes with a stage name and she is a complete moron. So, I want to trademark her name to teach a lesson. If I trademark her name than could I ask her to not use that name in the future since I own it? Please advice!

Re: Trademark

You want to "teach someone a lesson" because she's a "moron" and your method of doing this is to attempt to benefit yourself financially by appropriating her name.

I'm not sure I understand. This is a good idea ... why?

Re: Trademark

What a ridiculous notion.

You can't trademark someone else's name.

Trademarks are to identify the source of goods and services, and they must be used in commerce to be registered.

You cannot defensively register/own trademarks to prevent another from using them.

I agree with Mr. Stone - Grow up.

Re: Trademark

In order to register the trademark, you'd have to sign a declaration under penalty of perjury.

Filing a false government document is a crime.

Don't do it.
