Want to sue a firm in Canada for fees paid (less than $5000)from California for

Hi,

I live in California,and I want to sue a firm in Canada.I had a contract with them for providing immigration services,and I feel that they did not provide the service.I paid them money which i want back. So

1.Do I sue them in California court or Canada.(I will not be able to go to Canada)

2.Do I go to small claims court and what form should i fill.

3.What area of law (intn'l,business,consumer)does my case fall in.

Howdy:

Were the services provided in California or Canada? Does the firm have a presence in California? Or, did you transact business with them by mail, phone, or internet?

If they were always in Canada; and the services were to be provided in Canada; and the tranaction was by mail, phone, or internet; then you will have to pursue it in Canada.

If they solicited your business in California, then you may be able to file in Cal, but not in small claims court ... at least, not usually.

But, if there's a written contract, it may specify venue. Check that.
