1)If a contract signed in uk for employment in usa, binding? is the re-embursment fee clause enforcible? and $10,000 recoverable if employee terminated employment for variety of reasons such as unsafe working conditions etc.?

2)how long has a company got to enforce such a clause, from termination to filing?
