Legal Question in Employment Law in California

descrimination in the work place

Where I work there is a no tattoo policy. There are several people in management that do not have to cover there tattoos up because of there high position in the company. If i get fired for showing my tattoos , can i make a discrimination case.

Re: descrimination in the work place

Hello,

The answer is: Probably not, unless you can show that the reason you were treated differently was because you belonged to a protected class (race, age, ethnic origin, disability, religious beliefs, etc.)

Tattoos themselves do not make you a member of the protected class, so that alone does not give rise to discrimination action.

Thanks,

Arkady
