Legal Question in Employment Law in California

My employer is denying us to defecate in our bathroom, the toilet seat is taped up with saran wrap and a paper on it states "No #2"

Can we sue for this? It's only in the men's restroom the ladies are allowed to do their business.

HR department is close with our manager on a buddy basis and one employee got retaliated against when he mentioned it to HR.

The company is a huge telecommunications company. We are looking for attorneys to help us sue the company. We have picture evidence and colleagues to testify.

This is an OSHA type violation, which should be reported to Cal-OSHA. Yes, you could sue for the violation of 'safe and clean workplace rules' if you can show no full bathroom facility was available to you.
