Legal Question in Employment Law in California

Having a hard difficult time collecting judgment from former employer. employer submitted a NSF from one of his dummy LLC that has been cancelled since 2012. Labor board put that llc name as the plaintiff even after I warned them I was never employed by said dummy corp. So now I have a judgment of 18,000 against a dummy corp.

Question: Can I ask a judge to dismiss or throw out this case and go after the employer that I was actually employed ?

You don't really want the judgment dismissed or thrown out. You want to have the judgment against your real employer.

I am not sure what you mean by the LLC being "cancelled." Depending on what happened to the LLC, it may be possible to pursue the former owners.

You may need to start a new action against the true employer. This can be either before the labor commission or in the courts. I would speak to a litigator before proceeding down this path, as many people who sue without a lawyer get overwhelmed by the process.
