Legal Question in Employment Law in California

Is it illegal to ask for a settlement without a lawyer? My employer has committed several labor law violations but I do not want to go through the stress of a lawsuit. I want to settle out of court with them, but I fear asking for money will lead to legal repercussions.

Your question is premature. If you have a claim a lawyer can be very helpful in pressing that claim and making a case and thus helping you achieve your objectives. Note claims settle all the time but whether it has legal and factual merit is a different matter hence why attorneys exist. Thus consult a local attorney and they can help you go from there.

Of course it is not "illegal" for you to ask your employer to pay what is owed to you. However, if your employer is violating labor laws, you may not understand the penalties, etc. that may be added to your claim. Many times, a lawsuit is not necessary. Usually, after the company gets a letter from an attorney outlining the violations and what is owed, they settle. You should consult with an attorney and you and he/she can decide the best way to proceed. 949-481-6909.
