Legal Question in Employment Law in California

Illegal wage payment practices

I was hired on 7/7/2004 for the position of Accessory 2 that pays $11.20 per hour, but when I started work they had me work in a different position that pays less. I worked in this latter capacity for 3 days and was paid at a rate of $8.64 per hour. Then the following week they let me perform the job that I was hired to do. They paid me for that position ($11.20 per hour, the wage at which I was hired. The next week they had me go back to the position that they had me perform during the first three days on the job. Again this was for less pay than I was hired at. My question is this: Is it legal for a company to hire you for a certain position at a set pay rate and then when starting to work for the company they tell you that you will be doing a different task that pays less then what you where originally promised when being hired. This must be an illegal practice that the company is performing on its employees, because I should get paid at the rate for the position that I was hire at. I have no control over what they will ask me to do but I should know that I will be paid the rate that I was promised when I was hired. Would you tell me if this is legal or illegal and where can I find information from the government.

Re: Illegal wage payment practices

It violates your agreement. You might go to the California Dept. of Labor and file a complaint. Also, if this is a big company with many resources, you might talk to a class action lawyer, since this kind of thing might always occur.
