Independent Contractors and Labor Laws

My current employer is paying me as an independent contractor even though she treats me like a regular employee. I know that this may not be ''legal'', what is my liability there? And do the State Labor Laws still protect me as an employee?

Regardless of how an employer treats or labels you, if you are an employee based on legal standards, you are covered by the provisions of the labor code and regulations.
