Legal Question in Employment Law in California

Layoff Severnace

I was recently let go in a layoff. I was informed that my position was eliminated. Since my layoff, a new manager has been hired in my place. The title is Manager and my title was Director. I do not think my position has been eliminated. I would like to have more than two months severance. What are my rights? I think my being layed off was personalized by the Sr. VP of Fiance.

Re: Layoff Severnace

If your layoff excuse was "pretexted" on a fabricated reason, and was based on "bad cause", you may have a very actionable claim under the circumstances. For a free phone consultation, contact us directly this week.

Re: Layoff Severnace

You're an 'at will' employee in CA, and can be fired any time, for any reason except illegal motive like discrimination. You have no 'right' to severance unless your written contract or company policy states you do. An experienced attorney may be able to negotiate a severance package for you, with the right facts in your favor. Contact me if interested in doing so.
