terminated employees paying back cell use

Can I make an ex-employee pay back any cell phone invoices that he or she ran up into the thousands??

what are my legal options?

You have several options. But your agreement with the ex employee about the phone is important. Was the phone to be used only for business use? was that agreement in writing? Was the phone turned over at the time of the termination? These questions are important to determine how strong your breach of contract claim would be. You may also sue in small claims court (without attorneys) if the amount is less than $5,000. Are there other things that the ex employee owes for? Such as destroyed equipment or company equipment not returned?

Apparently the phone was in your name, since you have received the bill. How did you have the ex employee pay for personal calls before the termination?

These are questions that will help give you more options.
