Legal Question in Landlord & Tenant Law in California

Damaged property again!

Last year I noticed that my daughter's closet floor was wet and all the shoes & clothes & Toys on the floor was mildewed. I called the landlord and he sent over some of his plumbers from the plumbing shop he owns! And they could not find the cause of the leak and had my husband dig a trench next to the house and had his guys do something and supposibly was fixed! Today I go into my closet to get my shoes and find my floor soaked and my shoes and boxes ruined! My daughters closet still has mildew growing and the landlord has done nothing to fix any of the concerns I have. My daughter and son and I have asthma and I am worried that we are all breathing in mold! I am on a fixed income and could not afford legal help and my landlord know's this. What can I do to get the help I require and also can I hold the landlord responsible for my damaged property?

Re: Damaged property again!

You can call the local health agency and have the property inspected. It can issue a citation and require that it be fixed within a certain time period.

Also, take photos of the damaged personal property and obtain an estimate for their replacement. First, send the landlord by certified, return receipt mail a demand to repair the premises and pay you $XXX for your damage. Provide an itemized list and keep a copy. If, by the deadline you provide, the landlord doesn't talk to you about it or even pay, then you could go to small claims court. Good luck to you.
