deposit withheld for cleaning

When moving out, I was present at the inspection and the manager's assistant never stated any problems or had any of us sign anything. Now their charging us $130 for cleaning and the assistant is saying she told us all about the problems but forgot to have us sign. Are we responsible?

Did you receive anything in writing from manager's assistant? If so, read it carefully.

When you say "we", I assume there were at least you and another witness when assistant says she told you about problems.

I would file suit against landlord, for withholding deposit. California law says a judge can award you the $130, plus $600 from landlord if judge feels he/she acted in bad faith.

You may want to retain an attorney to write a strong letter to landlord, considering the damages you have at stake.
