Legal Question in Landlord & Tenant Law in California

Eviction Time Period

Our landlord filed for bankruptcy. We paid no rent for 5 months. Someone purchased the house at an auction in October and we paid rent for the month of November. How much time must the new landlord give us if he wishes to evict us, since we only paid him for one month? If we don't pay any rent for the first week, and then move, can he come after us for the unpaid rent?

Re: Eviction Time Period

Since you are a tenant and not the owner, you have to be given 30 days notice. If new owner accepts rent from you, the 30 day notice is rescinded. If you are given a 3 day notice for non payment of rent, you can pay the rent and a new tenancy is created. Normally, this is not done.
