Legal Question in Landlord & Tenant Law in California

My landlord hired property management before moving to NM. They have been unjustly charging me late fees and notice fees since 2015. My contract includes the owner, HUD, and myself. Property Management has been charging late fees for rent payments received after the 5th of the month, my contract States I have until the 7th. They charge a $45 late fee and a $40 notice fee. My contract says $40 is the amount owed for late payments. Isn't this considered breech of contact? Can't I legally refuse to deal with them?

You may not be able to refuse to deal with them because the owner can assign an agent. However, you can tell them that their fees are not in accordance with the contract. Write a letter and cite the section about late fees. If that doesn't work, contact your landlord and let him know.
