Legal Question in Landlord & Tenant Law in California

Landlord refuses to give security deposit back, haven't signed a lease nor moved in. Notified him with in 10 hours of giving the money that we will not be taking the place. Other details: We met the agent and paid the deposit in the same day, he never took down the ad for the place--didn't have time to. He gave us the keys and said he would have to run a credit check on us another day, and to sign the lease another day. No agreement was signed. We notified him less than 10 hours later that we don't want the place and we'll give the keys back. He said he will keep the security deposit (which he explicitly stated was for damages only) and to call him back in 4 days. Is this legal? Can he keep it?
