Landlor-tenant dispute

Does the law allow a landlord to refuse a rent check that is over three days past due and evict the tenant even if it is the tenant's first offense of any kind and he/she agreed to pay the required penalty for late payment?

The answer depends on many factors, including what your lease indicates. Some leases do reserve these kinds of rights, but if you tendered the full amount with the penalty and there are no other problems I am surprised your landlord would rather evict you.
