Legal Question in Landlord & Tenant Law in California

lease addendum validity

Hi, I live in an apartment complex (~200 units) with a month-to-month lease. The management company wants me to sign a lease addendum, but I don't agree with it. Should I ignore it, attempt to negotiate, other options? If I never sign it, can they evict me for violating it?

Re: lease addendum validity

If you refuse to sign it, they won't evict you right away, but they will give you notice terminating your tenancy. Because you are month-to-month, your tenancy can be terminated by a 30 day notice (if you have lived there less than a year) and 60 day notice (if you have lived there more than a year). The termination of your tenancy can be done without any cause whatsoever, so it would be very difficult for you to claim that their termination was retaliatory or illegal.

Without your sending the contents of the addendum, I'll try to answer.

Ignoring it will get you evicted while negotiating cannot hurt. Never signing will also get you evicted.
