I live in a rent control unit in Los Angles. I have gotten a rent increase for the past 30 plus years. It has always been mailed. The rent increase is subject to go into effect September 1, 2015. They mailed my notice which I received August 4, 2015. It was post marked July 31, 2015. Per civil code 827 and 1013 are they suppose to give me an additional 5 days if they are does that make that make the rent increase in effect October 1, 2015.

Generally, notices of rent increase that are sent by mail go into effect 35 days from the date of mailing. It is possible that the Rent Control Board has a different rule, so you may want to check with them.

Under your scenario, the rent increase goes into effect September 6, not October 1. You owe your current rent at the daily rate from September 1 to September 5, and the increased rent at the increased daily rate from September 6 on. To calculate your daily rate, multiply your current rent by 12 months, then divide that number by 365 (days in the year). Multiply that daily rate by 5. That is what you pay for the first 5 days. Then do the same calculation for the increased rent, multiply that number by 25 (the number of days left in Sept.) and that is the amount you pay for the rest of the month.
