I no longer have a lease with my landlord. We pay month to month. Have given my notice, he wants to charge me for 1/2 month rent. I am moving of the 5th of January.

You owe for 30-days after your notice, or until you move out, whichever is longer. So if you gave your notice on December 6 or before and move out 1/5, you owe rent for 5 days in January, which would mean 16.67% of a full month's rent. If you gave notice later or move out later, then you owe 3.33% of your monthly rent for each day in January until you move out or have paid for 30 days after you gave notice, whichever is more.
