Legal Question in Landlord & Tenant Law in California

A few months ago I moved out of my old apartment after graduation in December, and I instructed one of my old roommates to keep all my mail in a box. I have just returned to pick up my mail in April, and she only gave me 3 mails. She said the rest of the mail were left on the kitchen table and she doesn't know what happened to them. I think she either threw them out or possibly even opened my mail. I have been expecting a $1300 reimbursement check and it is now lost. I want to know what I can do to sue her or get this remedied. Thank you.

It is doubtful that a court will find your former roommate responsible as you could have quite easily taken steps to make sure that the check was sent to a secure location by having the mail placed on hold with the U.S. Postal Service or directing the mail to a private mailbox. I recommend you use your energies to get the reimbursement check re-issued and be mindful of any arrangements you make for having mail delivered to a location that you control or specifically to the attention of someone who has been warned that you may be receiving something vital, i.e. a reimbursement check.
