Legal Question in Landlord & Tenant Law in California

Hello, My niece by marriage moved into my home with her daughter, boyfriend and his son. They were only to stay for 2 weeks but it lasted longer than that. I asked them to pay 900.00 in rent and she told me that was to much for 2 bedrooms and a full bathroom. My niece was rude and ran up on me very loud and confrontational. I asked them to move out and they did. He came by on 2 different occassions to get some of their things. How long do I have to give them to come get the rest of their things before it is considered abandoned?

You need to review the California Civil Code as it relates to property left by tenants. Property left behind by tenants can be categorized as either abandoned, or lost. Look at Civil Code �2080 and the sections that follow. Look also at Code of Civil Procedure 1174. Even though they did not pay rent, and may not have been tenants, you have to treat their property as if they were. Generally, the code requires notice to the former tenants, then possibly sale at a public auction.
