Legal Question in Landlord & Tenant Law in California

third pty claim

tenant a gave landlord deposit for apt. landlord later decided not to let tenant a move in. went to court landlord lost ordered to pay back deposit. landlord refused and yesterday served tenant b who has nothing to do with tenant a paperwork stating landlord has filed a lein against tenant b for what landlord owes to tenant a. tenant b only met tenant a when they were going to move into bldg. Why does landlord think they can do this. Tenant b only lives in the bldg and has nothing to do with tenant a. should tenant b get a lawyer as paperwork submitted is confusing. landlord gave tenant b some of origional paperwork that states landlord owes dep money to tenant a and needs to pay back. I am asking for tenant b as he is old and does not understand all this. actually i don't either. any help is greatly appreciated

Re: third pty claim

Thanks. This is a lot easier to understand than your previous try.

Since A is not asking for help,we will deal with B.

There is a major difference between routine "paperwork" and an actual complaint, which starts a law suit. If you can e-mail, fax, or scan (what you call paperwork), I can begin to give you some answers.

I can't guess what landlord is trying to do, other than collect money. If he has a right to unpaid debts, then he should try to collect in any way he sees fit. Again, I need to see what you call "paperwork".

Please feel free to e-mail, or call, my office and I'll try to make some sense out of this.

It would also help to know if a lien was filed, or just threatened, and what is the debt that involves the lien?

Re: third pty claim

what is the relationship between tenant A and tenant B? It sounds like they were planning to move in together and paid deposit together? This is where it gets a little muddy. I'd need a little bit more information before I could provide a good answer.

Please email me directly, I am in Pasadena and travel to the SFV often, so I am close enough to assist you.
