Legal Question in Landlord & Tenant Law in California

rent per tenant

I am switching out of my apartment to one down the hall, but since I will be a ''new'' tenant in this apartment the landlords are saying that they will charge me more rent than the current tenants who are re-signing the lease. Is this legal? We are all signing the same lease, so can they charge one tenant more than the others? Thanks!

I would suggest that you check with the City's Rent Stabilization Board. It's possible that they're asking more than might be permitted, especially if you were forced to leave your old apartment. Seems to me that they should offer you rent similar to what you've been paying if you've been a good tenant and the spaces aren't really any different. Who's to say?!

The answer, unfortunately, is "Yes". They can charge more for one tenant than another.

Each lease is a separate contract.
