rented a room but could not move in; no refund

My boyfriend gave property owner security deposit and last months rent to hold a room for rent until the current occupants moved out. A week before move in date he was hospitalized with a critical condition and informed his hosp. stay will be aprox. 4-6mos. The owner stated he spent the money and has no plans to return it.

You do not give enough facts for a legitimate answer.

Was anything in writing? Were there any witnesses, if not in writing? Security deposits can be held for unpaid rent, but there is no last month's rent in California.

When you say "he" was hospitalized, I am presuming that is your boyfriend, and not the landlord.

What does your boyfriend want? He may, or may not be entitled to the money. Has the landlord re rented the premises? How long was the lease supposed to be on the room rented (how many months)?
