Legal Question in Landlord & Tenant Law in California

Security Deposit

Our landlord emailed us after we moved out, notifying us of carpet damage only. Then a few days later we went to court over an eviction proceeding with him and the judge ruled in OUR favor awarding us our court costs. After our win the landlord suddenly found $1000 worth of damage, holes in the wall, painting, cleaning, and he did all repairs himself charging $50/hour. It is obviously retribution for our win, we have moveout pictures debunking his claims of any damage other than rug. Since his first notification only states that there was damage to the rug, can he go back later and add more things to the damage list? Can he charge $50/hour for his own time?

Re: Security Deposit

He can go back, but that doesn't mean he can collect.

Also, unless $50 an hour is the prevailing wage for cleaning in your area, the $50 is extremely excessive.

Do not let this "miser" get away with this!
