Legal Question in Landlord & Tenant Law in California

I have a tenant in an inlaw unit in my home who has broken our agreement of not smoking and another person living in an agreed upon one person apartment. We have a 6 month lease now into the third month coming up in Oct. The tenant is aware of the limit of not more than 30 days in a year for another person living there. The tenant has not been here for 3 days now but her boyfriend is living there.

Can I legally terminate the 6 month lease at this time? Do I do a 30 to 60 day or can I do a 3 day notification?

I would suggest that you have an attorney review your lease first, and advise you as to your rights. If the written lease agreement contains a provision which states that the tenant will not smoke, then you would give a notice - the length of which is determined by your lease - to perform covenants or quit. These are often a three day notice, but I have seen leases where the tenant is to be given 15 or even 30 days notice to comply with the rules or leave.
