Legal Question in Legal Ethics in California

Can an Attorney do This?

My daughter was injured in an auto wreck 3 yrs ago, we hired an attorney to help us, we just now after 3 yrs have been told there is an offer, but that my daugter needs to sign a new retainer because she is now 19 (she was 16 at time of wreck) In which they want a higher percentage. When we as her parents originally hired them. can they do this?

Re: Can an Attorney do This?

She does not have to agree to a higher percentage. She can hire another attorney to negotiate with first attorney. They may be llimited to the original fee amount, less new attorney's fees, depending on what fee agreement stated.
