Legal Question in Legal Ethics in California

federal drug trafficing offense

My wife & myself were arrested at a TX border check 2/8/07 369 lb marijuiana.Wife was released with RV & I was held until 2/23/07. We needed a surity signature for $50,000.An accomplice sent an attorney to see my statement. My wife hired a law firm(fired theirs) $65,000 flat fee 2/15/07. No help or motion to get me out by them.A female attorney harrassed my wife constantly for the money. She sent $4,000 2/15 with the faxed nonre-fundable contract. She would call 3-way to my insurance agent to ask about our fire settlement to get money & also to mortgage companies we were trying to get loans from. She called one a liar and talked terrible to him.My wife was indicted a month later. She had to take a public defender after paying $65,000 up front for me. She pled not guilty & was going to trial in less than a week, the same law firm charged her $25,000 for a deal I made with authorities. The deal was off unless she wired $11,000 2 days before trial. She kept the public defender the whole time, still was required to sign contract $25,000 She didn't see anyone except my attorney & PD. I've only seen my attorney about an hour total 30 before each hearing.Grand Jury was 2/28/07, no work from them. There is so much more, we need help! Thanks

Re: federal drug trafficing offense

I am not quite sure of your question, despite all the details.

I am glad to help, and realize you and your wife are in severe trouble, due to the large amount of marijuana.

All I can tell you, without your asking a specific question, is that the law firm you hired, and paid, is outrageously unprofessional. The conduct you have described is enough to get the firm, and especially the female attorney, possible suspensions or more from the State Bar.

The State Bar also maintains a fee dispute committee that will arbitrate fee disputes, as your payment appears more like extortion than a legal fee.

Since your facts indicate that you live in the Winter Haven, Fla. area, and the arrest was at a Texas border check, I do not know how California became involved, and why the question is directed at a California attorney.

Bottom line, I need to know what your questions are concerning this mess, and what I, as a California attorney offering free advice on Law Guru, can do to answer direct questions.

Please either resubmit with clearer questions, or, if you feel more comfortable, please e-mail, or call my office.

All I can say is that I have been around a long time, and, according to what you have submitted, someone besides you and your wife, is involved in illegal activity.

Good luck!
