Legal Question in Legal Ethics in California

Legal name change

Hi, we jusy moved from Florida to California one month ago. My husband name is not spelled the way it should be on his Florida driver license (this occurred from bad spelling translation through immigration procedures).

We want to change the spelling of his name, do we need to do this on Florida documents (since that is where his license still is) or California? Thanks

Re: Legal name change

As I recall, CA law requires that after a short period of living in CA, residents must trade in their out-of-state licenses for a CA license. During that process, he should be able to make the appropriate name change. Also, CA common law permits a person to adopt whatever name he or she wants to use, so long as it's not for fraudulent or deceptive purposes. One then has to change all names on other documents -- including credit cards, etc. -- to conform.
