Legal Question in Legal Ethics in California

not notified of a problem

I do apologize if i wasn't quit clear .You see i feel i should have been notified of the problem .So that i could have corrected it. But the owner say's the fire chief sent the letter to the wrong address .Now i asked the fire chiefs office to send me a copy of the notice thay sent to him and thay had the same address i have .So if the owner did not change his address with the fire chief in which is his responsability . After the owner got the bill for the correction of the abaitment he did sent me a nasty letter demanding the money for the bill . And i sent a letter back basicly saying the he needed to notify me of the problem . So i could go and fix it .You see i've been doing this property once a year for three years and we've had no problems till now. Now i stand behind my work and i feel that the work was done right and in my opinion for what its worth i feel that this is his falt for not changing his address now if i'm wrong please let me know ....But its the principle that gets me if you think im wrong then ill settle up with him but i wont be happy about it i just dont think i'm . It feels like i installed a door and the owner slammed the door breaking it has sombody else fix it and then sends me the bill

Re: not notified of a problem

Since you have received a summons to Small Claims court, you need to tell the judge what you have stated here.

You need to bring whatever documents you have relating to this, and bring in neighbors (if they'll testify as to the quality of your work). Take pictures if you have a camera. If not you can buy disposable ones at Long's, Walgreen's Walmart, etc.

It is just like Judge Judy on television.

Good luck!
