Legal Question in Legal Ethics in California

Small Claims Question

I filed a claim in small claims against a former business partner. The date was set and she filed for a continuance which was granted on a day that I could not make it. I then filed for a continuance and the court told me that we each get to file one continuance... This was my last and it was granted. Now she just filed ANOTHER continuance. Is this a mistake by the court?

Re: Small Claims Question

Continuances are discretionary and the court can grant more than one for each sisde if good cause is shown. The written request may be made either by letter or on a form

adopted or approved by the Judicial Council. The request shall be filed at least 10 days before the hearing

date, unless the court determines that the requesting party has good

cause to file the request at a later date.
