Legal Question in Legal Ethics in California

Timing of Invoice

An attorney does some work. Doesn't

bill me for 20 months, (work done in

the summer of 2006, invoice dated in

May, 2008) then sends an invoice with

an apology. I don't think I'm obligated

to pay it. What do you think.

It's a bit ironic that you're asking attorneys for free advice about whether you should pay a colleague of ours who did work for you. Do you think we'd say "no"? I agree with Mr. Starrett's reasoning, despite my inherent bias.

Is there a written fee agreement? If so, you probably would need to pay but you may be able to negotiate based on difficulties caused you. There may be some defenses in the written contract also.

Accpet the apology and pay the attorney. Okay, so the attorney has sloppy business practices. But unless you have some other reason to dispute the bill such as negligent work or over billing, you should pay. You don't really think the attorney should do the work for free, do you?
